1. Acceptance and Scope
By downloading, installing, accessing, or using ProBikers ("App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms apply to our mobile apps, in-car integrations, website pages, and support channels.
2. Service Description
ProBikers provides rider-focused features that may include messaging, voice channels, maps and navigation context, follow/location tools, ride events, safety workflows, and account management features.
3. Eligibility
You must be at least 13 years old, or the minimum age required by local law (whichever is higher), to use ProBikers.
4. Account Responsibilities
- You are responsible for activity on your account and device.
- You must provide accurate information and keep it reasonably current.
- You must keep sign-in credentials secure and notify us of suspected unauthorized access.
5. Limited License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use ProBikers for personal, lawful purposes.
6. Acceptable Use Rules
You agree not to misuse ProBikers, including by:
- Violating laws, rights, or these Terms.
- Harassing, threatening, stalking, impersonating, or abusing others.
- Uploading unlawful, infringing, deceptive, or harmful content.
- Interfering with service security, reliability, or access controls.
- Scraping, reverse engineering, or attempting unauthorized access.
7. Driving and Rider Safety
ProBikers is an assistive product and not a substitute for rider judgment. You are solely responsible for safe riding, legal road behavior, and situational awareness. Do not use ProBikers in any way that creates unsafe riding conditions.
For Android Auto and Apple CarPlay usage, prepare permissions and setup before riding whenever possible.
8. Permissions and Device Features
Certain features require permissions such as location, microphone, camera, notifications, and contacts (where applicable). If permissions are denied or revoked, related features may be limited or unavailable.
9. User Content and Conduct
You retain rights in content you submit, but grant us a limited license to host, process, transmit, and display that content to operate, secure, and improve ProBikers.
You are responsible for ensuring you have rights and consent to share content, including media and personal information of others.
10. Moderation, Suspension, and Termination
We may investigate misuse and enforce policies by warning, restricting features, removing content, suspending accounts, or terminating access when necessary for safety, legal compliance, abuse prevention, or platform integrity.
11. Third-Party Services
ProBikers relies on third-party services (for example hosting, communication, mapping, notifications, diagnostics, and analytics). Your use of integrated features may also be subject to third-party terms and policies.
12. Warranty Disclaimer
To the maximum extent allowed by law, ProBikers is provided on an "as is" and "as available" basis without warranties of any kind.
13. Limitation of Liability
To the extent permitted by law, ProBikers and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business interruption.
14. Indemnity
Where permitted by law, you agree to indemnify and hold harmless ProBikers and its operators from claims arising out of your misuse of the service, your content, or your violation of these Terms.
15. Changes to Terms
We may update these Terms periodically. Continued use after updates become effective means you accept the revised Terms.
16. Governing Law
These Terms are governed by the laws applicable to the service operator, while mandatory consumer protections in your jurisdiction continue to apply.
